Welcome to the RosePost website. Please read these Terms of Service ("Terms”) carefully before accessing or using the http://rosepostbox.com website (the “Website”, “Site” or “Service”), and before subscribing to one of our subscription plans, buying a one-time RosePost box or ordering products from our Site. These Terms describe, specify and govern the RosePost relationship with you as related to the subscription services and products we supply via the website http://rosepostbox.com. By accessing, browsing or using our Site, you acknowledge that you have read, understood and agreed to be bound by these Terms. These Terms apply to all visitors, users and others who access, browse or use our Service. During checkout, by clicking 'Complete', you confirm that you accept these Terms.
The term “RosePost”, “us", "we", or "our" refers to the owner of this website. The term “you”, “customer”, “user” refers to the user or viewer of our Website.
By placing an order through our Website, you warrant that: you are legally capable of entering into binding agreements, you are at least 18 years of age and you reside in one of our serviced countries. Individuals under the age of 18 can use this Service only in conjunction with and under the supervision of a parent or legal guardian, in which case the adult is the user and is responsible for any and all activities, subscribers and purchasers.
We give you a non-exclusive, non-transferrable and non-commercial right to access our Website. We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to limit the sale of our products or Service to any person, geographic region or jurisdiction. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit and payment card information is always encrypted during transfer over networks. We reserve the right to modify, suspend or discontinue any aspect of this Website (including modifying the prices of our subscription plans), without prior notice, at any time. We shall not be liable to you or to any third-party for doing so. Your continued use of the Website constitutes your acceptance and agreement to any such modifications. If we modify the prices of our subscription plans and you are a current subscriber, your then-current rate will not change and will remain in effect.
2. SUBSCRIPTION PLANS
By purchasing any of our subscription plans, you acknowledge that your subscription plan has initial and recurring payments. You will be immediately billed at the date when you sign up and this date will be the renewal date for your subscription plan. At the end of the initial period specified in the plan, your subscription will be automatically renewed for successive periods of the same length until you cancel your subscription. For each of our subscription plans, you will receive a RosePost box quarterly, every three (3) months. The boxes will be the same, independent of the type of subscription plan chosen.
2.1. QUARTER-TO-QUARTER SUBSCRIPTION PLAN
RosePost Quarter-to-quarter subscription is a subscription plan, automatically renewed every quarter. If you sign up for this plan, you will be immediately billed the quarterly price on the date you sign up and your first box will ship following the RosePost shipping schedule. The date on which you signed up will be your renewal date and the recurring payment will be processed on the same date each three (3) months thereafter. For example, if a customer signs up on September 15th, she/he will be billed on that date for her/his first quarterly (fall) RosePost box, shipping in November. Then, the customer will be re-billed three (3) months later on December 15th for his/her next (winter) RosePost box, shipping in February, and so on, unless they cancel.
2.2. SEMI-ANNUAL AND ANNUAL SUBSCRIPTION PLANS (PREPAID)
RosePost Semi-annual and Annual Subscriptions are prepaid subscription plans for 6- and 12-months, respectively, and are non refundable. These prepaid subscriptions plans provide savings per RosePost box over the standard Quarter-to-quarter subscription. They automatically renew every 6 months and 12 months, respectively. For the Semi-annual (Prepaid) subscription, the initial charge is processed immediately when a customer signs up for the subscription and the recurring payment is processed on the same date each six (6) months thereafter. For the Annual (Prepaid) subscription, the initial charge is processed immediately when a customer signs ups for the subscription and the recurring payment is processed on the same date each twelve (12) months thereafter. Your Semi-annual and Annual subscriptions are cancellable before the billing date for the next 6- or 12-months period, respectively, where the cancellation will apply to the next subscription term.
2.3. ONE-TIME GIFT BOX PURCHASES
You have the option to purchase a one-time box. This type of purchase is billed at the time of purchase, with no recurring payments. The one-time box will contain a selection of niche ingredient-conscious rose-infused beauty products, and may also include select rose-infused home and / or food items. The box will be shipped immediately, unless you specify a later shipping date is needed, within five (5) business days. Each box will contain a unique mix of items that may vary from those in the standard subscription and / or in other one-time gift boxes, but will be of the similar value and quality, appropriately representing the RosePost Service.
3. CANCELLATIONS AND SKIP OPTION
3.1. AUTOMATIC RENEWALS OF YOUR CURRENT SUBSCRIPTION PLAN WILL CONTINUE UNTIL YOU CANCEL YOUR SUBSCRIPTION. You can cancel your subscription at any time by emailing us at: [email protected] or directly by logging into your customer account, before your next re-billing date.
For Quarter-to-quarter subscriptions, you need to cancel any time before your recurring billing date for the quarter if you don’t want to receive that quarter’s box. If you cancel after you were billed for the quarter, you would still receive that quarter's box, but will not be receiving any further boxes.
For Semi-annual and Annual prepaid subscriptions, you need to cancel any time before the re-billing for the next 6- or 12-month period, respectively. Since the semi-annual and annual subscriptions are prepaid and nonrefundable, any cancellation requests would go into effect at the end of the semi-annual or annual period, e.g. would apply for the next billing term.
3.2. You also have the option to SKIP a delivery directly by logging into your customer account. You will need to skip before your next re-billing date for it to go in effect for the next quarter's box.
4. SHIPPING AND DELIVERY
4.1. QUARTERLY DELIVERY
Each quarter / season, a RosePost subscriber will receive a box with 3-5 full-size ingredient-conscious rose-infused beauty and skincare products. Occasionally, the box may include select rose-infused and / or rose-inspired home / food / lifestyle items. Subscription boxes ship quarterly / seasonally, every third month, between the 1st and the 5th of the shipping month, following RosePost shipping schedule.
4.2. QUARTERLY SUBSCRIPTION AND SHIPPING SCHEDULES
The RosePost box subscription and approximate shipping schedule is as follows. Please note shipping schedules will be affected if dates fall on a weekend or a public holiday:
- The fall subscription quarter covers August, September and October, with fall boxes shipping November 1st – 7th.
- The winter subscription quarter covers November, December and January, with winter boxes shipping February 1st – 7th.
- The spring subscription quarter covers February, March and April with spring boxes shipping May 1st – 7th
- The summer subscription quarter covers May, June and July, with summer boxes shipping August 1st – 7th
4.3. SHIPPING AND ARRIVAL DATES ARE ESTIMATES ONLY
Once your RosePost box has shipped, we will send you a confirmation email. We ship via USPS Priority (unless otherwise stated in the shipping notification email) depending on the distance and zones in the U.S., it takes anywhere 2-3 business days (according to days stated by USPS). Our experience shows it sometimes can take longer, 3-4 business days. Please note, delivery in Canada typically takes longer. Thus, shipping dates and / or arrival dates should be interpreted as estimates only and you agree not hold RosePost accountable for any delays in delivery.
4.4. MISSING, LOST OR DAMAGED SHIPMENTS
If any product is damaged / defective, we will work with you to arrange a replacement. The new item that we send to you may be a replacement product of the same kind, or a different product type, but of the same value. To request / claim a return of a damaged product, you must contact us within 5 days of receiving the product at: [email protected] We retain the right to ask you to send back to us the defect product at your own cost. Once tracked as 'delivered', we are not responsible for any lost or stolen shipments. We are not responsible for packages delivered based on incorrect and / or incomplete addresses as stated in your Customer Account.
RosePost may, on occasion and in its sole discretion, offer promotional codes for discounts for subscription services. Promotional codes are non-transferable and are not redeemable for cash, credit, or toward previous purchases.
6. REFUNDS, RETURNS AND EXCHANGES
All purchases are final and we do not offer refunds, returns or exchanges to your RosePost boxes. The surprise element as to the specific products you will receive in each RosePost box is at the core of our subscription discovery experience, and we put much effort to plan and curate the boxes quarterly, sourcing and selecting products that you might normally not be able to acquire yourself. We hope that you would love all the clean rose-infused beauty products you discover in your RosePost boxes, but if there are still items you absolutely do not want to or cannot use, please consider gifting or donating them. We would happily replace a defective or damaged item as described in section 4.4.
7. USE OUTSIDE OF THE UNITED STATES
We administer and operate our Site from the United States. We make no representation that the subscriptions and products on the Site are appropriate or available for use outside the United States. If you choose to access this Site from outside the United States, you do so at your own initiative and are responsible for compliance with any local laws, to the extent local laws are applicable.
8. USER ACCOUNTS
8.1. SETUP AND INFORMATION ACCURACY
When you purchase a RosePost subscription or a one-time box on this website, you will be required to create an account with Subbly.co (our subscription checkout platform partner) before completing checkout, in order to manage and monitor your own subscription. Once created, you will be able to manage and update your information and preferences directly by logging into your account.
As part of managing your account, you agree to provide current, complete and accurate purchase and account information for all subscriptions and purchases made on our Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
8.2. ACCOUNT SECURITY
When required to create an account with Subbly.co, you will need to create a login name and a password. You are responsible for protecting your login and password from unauthorized use, and you are responsible for all activity that occurs on your account (including financial obligations). You agree to notify us immediately if you believe your login and / or password have been or may be used without your permission, so that appropriate measures can be taken. We are not responsible for losses or damage caused by your failure to safeguard your login and password.
9. THIRD-PARTY LINKS
Our Website may contain links to third-party Websites that are provided to you for reference and information purposes. Any outside Website accessed from our Website is independent from the RosePost Website, and we have no control over the content on such Websites. We are not responsible for any loss or damage incurred in connection with your use of such links or interactions with the owners or operators of such third-party Websites.
10. CORRECTION OF ERRORS
We reserve the right to correct any inaccuracies, typographical errors, or omissions and update information at any time without prior notice, even after an order has been placed from the user. Please note that some of these corrections may relate to subscription plan(s) description, pricing or availability. We therefore reserve the right to cancel any orders that are based on such inaccuracies, errors or omissions. We will always notify you of such cancellation. If your credit card has been charged and your order is canceled, we will issue a refund to your credit card.
11. NO PROHIBITED USE / INTELLECTUAL PROPERTY RIGHTS
As part of these Terms, we require users to agree not to use the Site, and specifically prohibit use of the Site for any of the following: i) for any unlawful purpose; ii) to solicit others to perform or participate in any unlawful acts; iii) to violate any local, state, federal or international laws, rules and regulations; iv) to violate our intellectual property rights or the intellectual property rights of others; v) to submit false or misleading information; vi) to attempt to interfere with the functionality or security of the Site or any related Sites. We reserve the right to terminate your use of our Service for any violations of these terms.
The logo, content and all other visuals on our website (including, without limitation, the Website design, text, graphics and all software connected with the Website) are owned by or licensed to the RosePost as permitted by law, and protected by copyright laws. In accessing the Website you agree that you will access the Content solely for your personal, non-commercial use. None of the Content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.
RosePost makes no representation or warranty of any kind, express or implied (including warranties of fitness for a particular purpose) regarding this Site or its contents, all of which are provided on an “AS IS” basis. Any use or reliance on information on this Site will be at your own risk.
12.1. NO PROFESSIONAL ADVICE
While we recommend all of the products that are included in the RosePost boxes, RosePost is not an expert on rose essential oil (or any of its derivatives), other essential oils and key ingredients that may be found in the products offered in the RosePost box, their uses in beauty care, skincare and aromatherapy. The information provided on this Website is based on personal opinions, experiences and research, and is provided for reference purposes only. It is not intended to diagnose, cure, prevent or treat any disease. It is not meant to be and should not be taken as professional advice. If you have specific skincare or health-related concerns and questions about the products, we recommend that you should always seek professional advice. Some essential oils are not recommended for women who are expecting or breastfeeding, or for children, and you should always consult a healthcare professional before use. We recommend that you always do a skin patch test before using any of the products. RosePost will not be liable for any damages, losses or injuries based on use of any information provided on our Website.
12.2. DISCLAIMER OF WARRANTY
RosePost does not guarantee that the ingredient, allergen and other product information provided on our Site are complete or accurate, since it is based on the information from various product manufacturers and suppliers we work with. Occasionally, manufacturers and suppliers may modify their products and update their labels. We recommend that you always consult the product labels with detailed ingredient list and allergen information, always to a skin patch test and seek professional advice if you have specific allergic or dietary concerns.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROSEPOST, INCLUDING ITS REPRESENTATIVES, EMPLOYEES, SUPPLIERS, PARTNERS OR THIRD PARTIES PROVIDING INFORMATION ON THIS SITE, BE LIABLE FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE OF ANY KIND (INCLUDING WITHOUT LIMITATION ACTUAL, CONSEQUENTIAL, PUNITIVE OR OTHERWISE), IN CONNECTION TO THE USE OR INABILITY TO USE THIS WEBSITE, THE USE OR MISUSE OF THE PRODUCTS OR ANY INFORMATION CONTAINED ON THIS WEBSITE.
YOU AGREE THAT ROSEPOST’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS AND CONDITIONS, THE WEBSITE, CONTENT, OR ANY PRODUCT OR SERVICE WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED IN AGGREGATE THE TOTAL AMOUNT YOU PAID TO ROSEPOST IN THE QUARTER PRECEDING ANY SUCH CLAIM.
14. TERMS CHANGES & MODIFICATIONS
We reserve the right to modify or replace these Terms at any time. If a revision is deemed material, we will provide at least a 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We recommend that you periodically review these Terms to be informed of any modifications / updates.
